Can temporary residents buy properties in Canada?

The answer is yes, temporary residents can still acquire properties in Canada, as long as they are intended for residential use. In their case, the following conditions apply:

  • they must have been physically present in Canada for at least 244 days in each of the 5 calendar years prior to the year in which the purchase was made;
  • the purchase price of the residential property must not exceed CAD 500,000;
  • they have not acquired more than one residential property;
  • they have filed all required income tax returns under the Income Tax Act for each of the 5 taxation years preceding the year in which the purchase was made.

For those who migrate to Canada based on temporary work permits, the following conditions apply:

  • if the employment is full-time as defined by paragraph 73(1) of the Immigration and Refugee Protection Regulations, they must have worked in Canada for a minimum of 3 years during the four years prior to the year the purchase was made;
  • they have not bought more than one residential property;
  • they have submitted all required income tax returns under the Income Tax Act for at least 3 of the 4 taxation years prior to the year the purchase was made.
